Terms and Conditions for Staycation 2024 Operation

Preamble

The Saint-Martin Tourist Office organizes the Staycation 2024 operation exclusively for residents of Saint-Martin / Sint-Maarten. These terms and conditions (T&C) govern participation in this operation.

1. Purpose of the Program

The Staycation program is made available to Users by the Saint-Martin Tourist Office as part of the “I Am Saint Martin Staycation” operation, providing functionalities for:

  • Professionals participating in the operation: account creation request with the Saint-Martin Tourist Office, validation of offers/discounts at point of sale, and tracking of revenue during the Staycation operation.
  • Individuals wishing to benefit from the operation: account creation and use of offers/discounts.

The Saint-Martin Tourist Office reserves the right to modify the list and content of the program’s functionalities at any time without prior notice.

2. Access to Program Functionalities

To access program functionalities, Users must:

  • Register for the program on the website www.staycation-saint-martin.fr.
  • Receive their virtual or physical card (subject to availability).
  • Have a mobile device (for virtual cards) with a Wallet option.

3. Program Availability

The program is accessible 24/7, except in cases of force majeure, outage, or maintenance. The Saint-Martin Tourist Office cannot guarantee continuous access to the Services. Maintenance operations may temporarily restrict access. Additionally, internet-related damages (service disruption, external intrusion, viruses, fraudulent use) are beyond the Office’s liability.

Furthermore, the Saint-Martin Tourist Office reserves the right to permanently discontinue Services without prior notice.

4. Use of the Program

Users agree to use the program for personal, non-commercial purposes, not to sell, rent, or market any part of the program, use it in accordance with its intended purpose, not infringe on intellectual property rights related to the program and its components, and not use illegal or rights-infringing data. The Saint-Martin Tourist Office may delete such data without notice, without Users having the right to claim compensation. Non-compliance with established terms may result in Users being removed from the Staycation program.
Users are responsible for their use and actions, whether fraudulent or not, and indemnify the Saint-Martin Tourist Office accordingly.

5. Services Offered by the Program

The Staycation program allows:

  • Professionals to access transaction dashboards, validate client offers/discounts by scanning the client’s QR Code on their mobile device or physical Staycation card, and comply with registration conditions outlined in the call for applications.
  • Individuals to register for offers/discounts, submit required documents to validate account opening, present a QR Code associated with an offer/discount at checkout (via virtual or physical card), and access the directory of participating professionals.

6. Participation Conditions for Individuals

6.1. Residence: This operation is exclusively for residents of Saint-Martin / Sint-Maarten.
6.2. Age: Participants must be over 18 years old.
6.3. Registration Period: Registrations are open from July 1st to August 31st, 2024.

7. Use of Offers

7.1. Usage Frequency: Offers can be used as often as desired, unless otherwise specified by participating businesses.
7.2. List of Participating Companies: The list of participating companies is available on the website www.staycation-saint-martin.fr.

8. Registration Terms

8.1. Online Registration: Registrations can be completed online at www.staycation-saint-martin.fr.
8.2. Physical Registration: Registrations are also accepted at the Saint-Martin Tourist Office headquarters (10 Rue du Général de Gaulle) or at the information kiosk on the Front de Mer.
8.3. Card Type: Virtual or physical cards may be requested, subject to availability (first come, first served).
8.4. Proof of Residence: Proof of address must be presented to participating businesses to validate the offer/discount.

9. General Terms of Use of the Program

Using the Staycation program implies full acceptance of these T&C by Users (individuals) and professionals (socio-professionals), certifying they are over 18 years old.

10. Collection and Use of Personal Data

10.1. Consent: By participating in the operation, you consent to the Saint-Martin Tourist Office collecting your personal data in accordance with applicable regulations.
10.2. Data Use: Collected data will be used for organizing Staycation 2024 and sending promotional emails by the Saint-Martin Tourist Office.

11. General Provisions

11.1. T&C Amendments: The Saint-Martin Tourist Office reserves the right to modify these terms and conditions at any time. Participants will be informed of any changes through www.staycation-saint-martin.fr.
11.2. Disputes: Any dispute regarding the interpretation or execution of these terms and conditions shall be subject to the jurisdiction of the competent courts of Saint-Martin.

By participating in Staycation 2024, you accept these terms and conditions.
